PROBATE

Experiencing the loss of a love one is always difficult.  After the loss, it is completely normal to feel overwhelmed and at a loss as to what to do next.  We can help guide you through the process of settling the loved one’s estate, which may include probate.  The complexity of settling an estate is often related to the size and value of the estate, but sometimes even a simple estate will require a full probate process.

Probate is a legal process in which a court oversees the administration of and estate.  Probate is not always required, but it is common to need to probate a loved one’s assets. Generally, probate is needed for assets that do not have survivor provisions or named beneficiaries. Probate may also be needed when there are disputes related to the will or assets of the decedent or money was owed to the decedent.  If the decedent had very little, then probate is usually not needed.

In Oregon, there are two probate processes.

  • Full Probate.
  • Small Estate Affidavit.

Which process is available or needed depends upon the size of the decedent’s estate, possible disputes, and what protections are desired for the personal representative, heirs, and devisees.
